Research Stop #2: The law and the challenge of transhumanism

The IERDJ organizes on Friday, December 2nd, 2022 the second edition of its new monthly meetings around the research it supports. Entitled Arrêt sur recherche, it is a recurring monthly event designed to bring together research and the field.

Come and take part in this rich and open dialogue between researchers and practitioners around a central question resulting from a research report supported by the IERDJ.

Transhumanism is open to all kinds of fantasies and it is useful to take the time to probe its multiple facets and its potential achievements. This is the purpose of the research “Transhumanism (s) and law (s)” conducted by Emilie GAILLARD (general coordinator of the Chair of Excellence CNRS Normandy for Peace) and Amandine CAYOL member of the Bioethics line of the Chair) between 2019 and 2022, the result of the collaboration of a multidisciplinary research team composed of lawyers, sociologists and philosophers who is also part of the legal cross-section (public law and private law / domestic and international law).

Are we already in a transhumanist society where “yesterday’s augmented has become today’s normal” as Daniela Cerqui, anthropologist, pointed out in 2018?

Researchers and practitioners will try in this “Stop on research” to understand what impact the concepts and achievements of transhumanism – highlighted in the research – have on the fundamental notions of law in particular with regard to the person and the fundamental rights that transcend all fields but that pose in a general way the question of the advent of a public order vector of a right to the future human condition.

For each of these principles and notions, are transhumanist ideas and realizations likely to create deviations and alterative consequences on both the ethical and societal levels? To what extent? What regulation or supervision to propose? This is what our three speakers will try to outline.

  • Amandine CAYOL, lecturer in private law and criminal sciences, member of the Caen Institute of Legal Research, member of the Bioethics line of the CNRS Normandy Centre of Excellence for Peace
  • Emilie GAILLARD, lecturer in private law at ScPo Rennes, general coordinator of the CNRS Normandy Chair of Excellence for Peace
  • Pierre DELMAS-GOYON, magistrate, honorary advisor to the Court of Cassation, member of the National Consultative Ethics Committee for Life Sciences and Health

The debate will be moderated by Sonya DJEMI-WAGNER, magistrate, general inspector of justice, general delegate for strategic development of the IERDJ.
