Exchanges with young researchers from Normandy

The Normandy Chair for Peace is organizing a series of meetings with young researchers from Normandy who are keeping the peace with the earth.

Our first guest was Fanny Dessainjean (Doctor of Private Law and Criminal Sciences, associate member of CUREJ): on February 22, 2021 from 5:00 to 6:00 pm

This meeting was moderated by Émilie Gaillard, coordinator of the Normandy Chair for Peace.

Fanny Dessainjean, PhD in private law and criminal sciences, associate member of CUREJ (EA 4703), ruralist, defended her thesis, entitled The reservation of varietal innovations, on September 20, 2019 at the University of Rouen-Normandy – Doctoral School Law Normandy – CUREJ (director: Ms. Professor LAROCHE, co-director: Mr. PESSINA (HDR Lecturer)). Her Thesis was surveyed and presented by the French Academy of Agriculture in May 2020 (analysis made by Professor BOSSE-PLATIÈRE).

The association of several subjects of private law in order to apply them to agriculture, food and environment defines her research method. Considering the contributions of new technologies and the legal problems that arise in rural areas enriches her field of research. The consideration of future generations in her work is also important, both in the elaboration of the latter and in their finalities. The questions relating to domestic animals (status, protection, responsibility) are also an integral part of her research.

Her thesis is a contribution to the internalist study of the ownership of new plant varieties based on the regime dedicated to new plant varieties. The fact that these innovations, contained in seeds, are the first links in the food chain, necessary for the production of food, has motivated this overall approach. The consideration of an agricultural and ecological transition via private law was also a source of motivation. The issues related to the appropriation of plant varieties independently of patent law are also revealed, in particular those related to food security and the vital functions of the goods in question. The first part is devoted to the exclusive reservation of varietal innovations (plant varieties). The second part focuses on possible legal alternatives.
