In order to consider the consequences of the multiple transformations that the notion of future generations may produce on the law and its practice, the Foresight and Innovation Commission (commission Prospective et Innovation) has undertaken, in partnership with Emilie Gaillard, Director and Coordinator of the CNRS Normandy Chair of Excellence for Peace, the drawing up of a report and of a resolution on the theme of the rights of future generations.
The aim of this report is to raise awareness of the active role and positioning that lawyers can play in the practice and understanding of the rights for future generations. More specifically, the report aims to outline the role of the lawyer as a defender of the rights and interests of future generations.
In its report, the CNB’s Foresight and Innovation Commission highlights a practical, pragmatic approach, proposing a reciprocal interplay of influence between a risk-based preventive approach, founded on solidarity between generations, and a judicial approach, founded on the recognition of fundamental rights, and for which the lawyer plays an essential role, particularly in its implementation.
