International Expert Meeting United Nations “Truth processes, transitional justice and reconciliation”.

At its twenty-first session in April-May 2022, the Permanent Forum recommended the organization of a three-day international expert group meeting on the theme “Truth, transitional justice and reconciliation processes”. This recommendation was approved by the Economic and Social Council (decision 2022/352). During this meeting, drawing on the Chair’s previous reflections on transitional justice, on Mrs. Emilie Gaillard’s work on the rights of future generations and on a transgenerational approach to human rights, as well as on Mrs. Leslie Cloud’s field experience with indigenous peoples, Mrs. Emilie Gaillard and Mrs. Leslie Cloud will present how a transcultural conception of the rights of future generations, respectful of the rights of indigenous peoples and of their ontologies, makes it possible to enrich and strengthen the mechanisms of transitional justice.

The objective of the expert group meeting is to build on policy recommendations and developments and identify barriers and gaps and:

  • Document UN or other mechanisms/bodies that support national efforts to address conflict, implementation of peace processes and agreements, truth, transitional justice and reconciliation processes.
  • Identify key considerations based on good practices in establishing truth, transitional justice and reconciliation processes to include Indigenous Peoples and uphold their rights, taking into account the vulnerabilities of Indigenous women and children.
  • Assess structural/institutional barriers that impede the participation of Indigenous Peoples in conflict prevention and resolution, peacemaking and peacebuilding processes.
  • Identify Indigenous Peoples-led consultation protocols/legislative initiatives to achieve consensus on the implementation of peace processes and agreements.
  • Prepare policy recommendations for all relevant stakeholders.

The final report and recommendations of the expert group meeting will be presented to the Permanent Forum on Indigenous Issues at its April 2023 session.

Proposed themes for discussions:

  • Four main themes for discussion are proposed below to guide the agenda. Under each of the themes, some preliminary questions will be prepared for consideration and to stimulate discussion.
  • Truth, transitional justice, conflict resolution and reconciliation: international law in the UN system;
  • Barriers to Indigenous Peoples participation;
  • Examples of lessons learned from work by and with Indigenous Peoples;
  • Standards and policies for conflict resolution, truth, transitional justice and reconciliation;
  • Recommendations to all relevant stakeholders.
