Beyond ethical obligations to posterity – A rule of law revolution in future generations litigation
There is a marked rise in the number of litigation raised in the name of future generations seeking to protect environmental resources and a safe climate system for posterity before a growing number of domestic and international jurisdictions. This talk will address how these lawsuits feature rule of law guarantees in an intergenerational context, and will examine states’ judicially enforceable obligations owed to posterity through a rule of law lens.
Dr Katalin Sulyok holds a PhD in International Law, a Bachelor’s degree in Biology, and obtained a Master of Laws degree from Harvard Law School. She is Assistant Professor in International Law and Environmental Law at ELTE Eötvös Lorand University, Budapest. Since 2014 she has been working as chief legal advisor to the Hungarian Ombudsman for Future Generations. Currently, she is a fellow in the Re:Constitution Programme on the Rule of Law and Democracy in Europe, through which she has been a Visiting Researcher at Sorbonne and at Aarhus University in 2022 working on her research project concerning the rule of law and future generations litigation.
